§ 1. General regulations

  1. The administrator of the stripdetective.com service (hereinafter: Service) and the administrator of personal data, is Strip Detective Barbara Urbańska, under addresse Fabianowska 132h1 62-025 Komorniki, Poland, VAT number: PL9721073293.
  2. These Terms and Conditions define the rules for the use of the Shop, in particular the rights and obligations of the Seller and the Customer, the rules for placing orders and concluding and terminating purchase contracts for products offered by the Seller, as well as the rules for the performance of these contracts and the rules of the complaint procedure and personal data protection. These Terms and Conditions also set out the rules for the provision of electronic services, which are provided only to the extent necessary to enable Customers to make purchases through the Shop.
  3. The User of the Website may be any natural person (hereinafter referred to as User).
  4. Customers may access these Terms and Conditions free of charge at any time on the website https://stripdetective.com/, including downloading and archiving the content of the Terms and Conditions or making a printout thereof. In addition, the Terms and Conditions are made available to Customers in the course of the order placement procedure.
  5. These Terms and Conditions are addressed to both consumers and businesses using the Shop, with the exception of points 7 and 8 of the Terms and Conditions, which are addressed exclusively to customers who are consumers, and with the exception of those provisions of the Terms and Conditions which expressly refer to consumers.
  6. Customers may communicate with the Seller by e-mail, as well as by telephone, and in writing (contact details as in section 1.1 of these Terms and Conditions), with orders being placed by the Customers using the order form, in accordance with the procedure provided for in section 3 of these Terms and Conditions.
  7. The announcements, advertisements, price lists and other information on the https://stripdetective.com/ website relating to the products contained therein do not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  8. Each User is obliged to familiarise himself/herself with the content of the Terms of Use before using the Website. By using the Service in any way, the User declares and confirms that he/she has read the Terms and Conditions, accepts its provisions and undertakes to comply with them.

§ 2. Services provided by electronic means

  1. The Administrator allows Users to use the following electronically provided services:
    1. reading materials prepared by the Administrator and third parties and made available by the Administrator in the Service;
    2. making a purchase of a Strip Detective test via the Website for self-testing for sperm under the terms of § 3 of the Terms and Conditions
    3. asking questions about the services offered by the Administrator by e-mail.
  2. In order to browse the Shop’s assortment and place orders, a computer or other multimedia device with Internet access and an operating system enabling the launch of a web browser (e.g. Mozilla Firefox, Google Chrome, Opera, Internet Explorer) with Javascript support and an active electronic mail (e-mail) account are necessary.
  3. The Seller informs that the main risks associated with the use of the service provided electronically via the Internet include in particular interference by third parties (so-called hackers), computer viruses, Trojan horses or spam (unsolicited electronic messages sent simultaneously to many recipients). It is in the interest of every user of services provided via the Internet to install legal and up-to-date software to protect the user’s device from the aforementioned threats.
  4. Customers using the Store are obliged to refrain from any unlawful activity, including, in particular, the provision of unlawful content and from interfering with the content of the Store or its technical elements.
  5. Complaints about services provided electronically can be submitted in writing or by e-mail (contact details provided in section 1.1. of the Terms and Conditions). Complaints will be considered by the Seller within 14 days.

§ 3. Long distance sales

  1. The administrator sells sperm detection tests. The Strip Detective test price is given in the Polish currency (PLN) as a gross amount (taking into account the applicable VAT rate). The Administrator is entitled to change the price of Strip Detective Test, while the change does not apply to orders already placed or being placed.
  2. The administrator accepts orders for the Strip Detective Test (hereinafter referred to as the Order) via the service
  3. It is a condition of acceptance of the Order by the Administrator that:
    1. provision by the person placing the Order (hereinafter referred to as the Customer) of the required data:
      a) name,
      b) the postal address to which the Strip Detective Test is to be delivered;
      c) contact details: telephone number, e-mail address;
    2. selection by the Customer of one of the following delivery methods: Poczta Polska, Inpost courier, Inpost parcel machine
    3. Customer’s choice of one of the following payment methods: transfer to the Administrator’s bank account; online payment.
    4. acceptance by the Customer of the total price of the Order, including the price of the Strip Detective Test including tax and delivery costs;
    5. availability of tests.
  4. Upon receipt of the Order, the Administrator will send an email to the email address provided by the Customer:
    1) in the case of availability of the Strip Detective Test, confirmation of acceptance of the Order, whereby confirmation will be conditional, subject to receipt of payment by the Administrator;
    2) in the event that Strip Detective Test is unavailable, information on the date on which the Order can be fulfilled, together with a request for its acceptance, whereby acceptance of a new date shall be deemed to be submission by the Customer of an Order by e-mail indicating a longer delivery date.
  5. The Administrator may refuse to fulfil a submitted and unpaid Order if:
    1) the data provided by the customer is incomplete;
    2) has a well-founded fear that:
    1. a) the data provided by the Customer is incomplete, incorrect or untrue, or
    2. b) the order was placed as a result of unauthorised interference with IT systems;
    3. c) the order is not paid for. In this case, the Administrator may attempt to contact the Customer in order to clarify the doubts.
  6. After placing an Order, the Customer may:
    1) withdraw the Order – at any time – by sending information to the following address: contact@stripdetective.com.
    2) make modifications to the Order – only with the consent of the Administrator.
  7. The Administrator shall not be liable for errors made by the Customer when placing an Order, in particular errors in the delivery address and/or contact details.
  8. The delivery time of the Order depends on the selected form of delivery and is no more than:
    1)7 working days when choosing the services of the Polish Post Office,
    2) 5 working days if courier service is selected
    3) 3 working days when choosing Parcel Machine services,
  9. Each Strip Detective Test is accompanied by:
    1) a proof of sale (receipt or invoice)
    2) Customer’s declaration of withdrawal (specimen withdrawal is attached as Appendix 3 to the Terms and Conditions).
  10. If, upon receipt of a Strip Detective Test, the Client finds that it has been damaged and/or decomposed, the Client should immediately notify the Administrator by sending an email to adres:contact@stripdetective.coml and returning the Strip Detective Test to the address: Barbara Urbańska, 132 h1 Fabianowska Street 62-052 Komorniki, Poland. The defective Strip Detective Test will be immediately replaced with a new one, within the time limits indicated in point 9. Return form: download here
  11. The customer has the right to withdraw from the contract within 14 days of receipt of the Strip Detective Test without stating a reason and without incurring costs, with the exception of the costs referred to in § 3.15 of the Terms and Conditions, provided that the test sachet for the test has not been opened.
  12. If the sachet has been opened after delivery, in accordance with Art. 38 para. 5) of the Consumer Rights Act, the Customer is not entitled to withdraw from the contract.
  13. The right to withdraw from the contract is exercised by the Customer by sending a completed and signed statement of withdrawal (attached to the Strip Detective Test), to the address Barbara Urbańska ul. Fabianowska 132 h1 62-052 Komorniki, Poland or after scanning by e-mail to: contact@stripdetective.com. Sending a letter / e-mail before the deadline of 14 days is sufficient to meet the deadline.
  14. When withdrawing from the contract, the Customer is obliged to send back Test Strip Detective at his/her own expense by registered mail to Barbara Urbańska Fabianowska 132 h1 62-052 Komorniki. Strip Detective Test may be sent back together with a statement of withdrawal from the contract.
  15. Upon receipt of the declaration of withdrawal, the Administrator:
    1) will immediately send an acknowledgement of receipt to the customer;
    2) not later than 14 days from the date of its receipt and receipt of the Strip Detective Test, or confirmation of the return of the Strip Detective Test, shall refund to the Customer all payments made by the Customer, including the costs of delivering the Strip Detective Test to the Customer.
  16. Refunds will be made using the same method of payment used by the Customer, unless the Customer specifies on the statement the bank account number to which the refund should be made.

§ 4. Personal information

  1. The use of the information provided on the Website does not require the provision of personal data. The provision of personal data is only necessary if:

    1) the purchase of a Strip Detective Test by the User;
    2) user’s questions.

  2. In the case referred to in § 4.1.1) of the Terms and Conditions, the User is obliged to provide the data necessary for the execution of the order placed by him/her, i.e.:

    1) name
    2) the postal address to which the Strip Detective Test is to be delivered;
    3) contact details: contact telephone, e-mail address. The aforementioned personal data will be processed by the Administrator, on the basis of Article 23, paragraph 1. point 3) of the Personal Data Protection Act, for the purpose of fulfilling the order placed, and subsequently deleted, with the exception of data required to document the performance of the service, processed on the basis of Article 23, paragraph 1. point 2) of the Personal Data Protection Act.

  3. In the case referred to in § 4.1.2) of the Terms and Conditions, the User is obliged to provide the email address to which the answer to his/her question will be sent, and may also provide his/her first and last name. The above personal data will be processed by the Administrator, solely for the purpose of answering the question, on the basis of Article 23, paragraph 1. point 3) of the Personal Data Protection Act, and will be deleted afterwards.
  4. Every User has the right to inspect their personal data, as well as the right to correct them and request their deletion. To do so, please contact the Administrator at Barbara Urbańska 132 h1 Fabianowska Street 62-052 Komorniki, Poland or send an e-mail to: contact@stripdetective.com.
  5. The Administrator shall not pass on, sell or lend the personal data provided by Users to other persons or institutions, except with the express consent or at the request of the User to whom the data refers, or at the request of authorised state authorities for the purposes of their investigations.

§ 5. Intellectual property

  1. The Service and the materials contained therein, including works, trademarks, databases, their selection and compilation on the Service, are subject to the protection provided by the applicable laws in this regard, in particular:

    1) the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 1994 No. 24, item 83. as amended);
    2) Act of 30 June 2000 Industrial Property Law (Journal of Laws 2001 No 49 item 508 as amended);
    3) Act of 16 April 1993 on combating unfair competition (Journal of Laws 1993 No. 47 item 211. as amended).

  2. By using the Website and the material on it, Users do not acquire any rights or licence to them.
  3. Without the prior consent of the Administrator, the Users may use the Service and the materials contained therein only within the framework of permitted use as provided for in the Act on Copyright and Related Rights. In particular, it is not permissible to reproduce, modify, publicly perform and/or make available the Website, its parts, the materials contained therein and/or their parts, with the exception of cases indicated in the applicable legislation in this respect;

§ 6. Cookie policy

  1. In order to collect information about Users, Administrator uses the mechanism of ‘cookies’, i.e. text files, which the server records on the disk of User’s final device. These files enable recognition of a User when reconnecting to the Website, but they are not used to identify specific Users, in particular on their basis Administrator does not establish the identity of Users.
  2. The Administrator uses cookies to remember information about Users, in order to:

    1) make it easier for the User to navigate the Website;
    2) producing statistics;
    3) reviewing and developing the range of services provided.

  3. Cookies are set when the User ‘enters’ and ‘exits’ the Portal. They do not in any way damage the system on the User’s terminal device or affect the way it works, in particular they do not cause configuration changes in the Users’ terminal devices or in the software installed on these devices.
  4. Any User can refuse to allow non-functional cookies to be placed on their terminal device in the built-in consent available on our website. You can update your consent at any time.

§ 7. Administrator’s responsibilities

  1. The sole source of the Administrator’s obligations is the Terms and Conditions and mandatory legal provisions.
  2. The Administrator shall make every effort to ensure that using the Website is possible for Users using all popular web browsers, operating systems, types of computers and types of Internet connections. However, the Administrator does not guarantee and is not responsible for the fact that any combination of the factors listed in the preceding sentence will make it possible to use the Services.
  3. The Administrator reserves the right to make technical interruptions in the provision of the Website.
  4. The administrator is not liable for:

    1) the way in which Users use the Website, nor for any consequences resulting therefrom;
    2) information downloaded from the Website, nor for the consequences of its use by Users, nor for its usefulness to Users;
    3) independent and faultless errors in the operation of the Website;
    4) damage caused by causes beyond the Administrator’s control and fault, in particular force majeure;
    5) for damages incurred by the User as a result of hazards on the Internet, in particular hacking into the User’s system, interception of passwords by third parties or infection of the User’s system with viruses.

§ 8. Complaints

  1. Each User of the Service has the right to lodge a complaint on matters relating to the functioning of the Service.
  2. Complaints concerning the functioning of the Service should be submitted by e-mail to: contact@stripdetective.com or by post to: Barbara Urbańska ul. Fabianowska 132 h1 62-052 Komorniki Poland.
  3. The Administrator will consider the complaint within 14 days of receipt.
  4. A reply to the complaint will be sent to the User at the address provided by the User in the complaint.
  5. The Administrator reserves the right to extend the period specified in § 8.3 of the Terms of Use by no more than 14 days, however, in the event that complaint consideration requires unusual, special activities and arrangements or encounters obstacles that are independent of and not attributable to the Administrator (hardware or Internet network failures, etc.). The Administrator also stipulates that consideration of a complaint may require obtaining additional explanations from the User – the time of providing such explanations by the User each time extends the period of complaint consideration.

§ 9. Other provisions

  1. The Administrator reserves the right to introduce, without prior notice to Users, changes to the software, graphic design and functionality of the Website.
  2. The Administrator reserves the right to amend the Terms and Conditions. Amendments to the Terms and Conditions shall become effective upon their publication on this website.
  3. The User’s use of the Website after the amendments to the Terms and Conditions have been introduced shall constitute acceptance thereof. If the User does not accept the changes to the Terms and Conditions, he/she should refrain from using the Service.
